Terms of Service for Maple Grove Garden Services Ltd.

1. Introduction and Acceptance of Terms
These Terms of Service (the “Terms”) govern the provision of garden and landscaping services by Maple Grove Garden Services Ltd. (“Maple Grove Garden Services Ltd.,” “we,” “us,” or “our”) to any client, customer, visitor, or user who engages our services, requests a quote, enters into an estimate or work order, or otherwise interacts with our business in connection with our services (collectively, “you” or “your”).
By requesting services from Maple Grove Garden Services Ltd., accepting a quote, booking an appointment, signing a work order, or permitting us to begin work, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not engage or continue to use our services.
These Terms form a legally binding agreement between you and Maple Grove Garden Services Ltd. In the event of any inconsistency between these Terms and a separately signed written service agreement, estimate, or work order, the signed written agreement or work order will prevail to the extent of the inconsistency.
2. Scope of Services
Maple Grove Garden Services Ltd. provides garden services, which may include the following, depending on the scope agreed with you:
- Garden design and planting plans
- Seasonal garden cleanups
- Lawn edging and bed maintenance
- Shrub and perennial pruning
- Mulching and soil amendment
- Weed control and hand weeding
- Container garden setup and care
The specific services, timing, frequency, pricing, materials, and any exclusions will be set out in a quote, estimate, proposal, service booking, invoice, or work order issued by Maple Grove Garden Services Ltd.
Unless expressly agreed in writing, our services do not include tree removal, pesticide or herbicide application requiring a license, irrigation system repair, hardscaping, electrical work, plumbing, structural work, or any work requiring a permit or specialized trade licensing beyond the scope of our ordinary garden services.
We may decline to perform any requested work that, in our judgment, is unsafe, unlawful, outside our capabilities, or inappropriate for the site conditions.
3. User Obligations and Responsibilities
You agree to:
- Provide accurate, complete, and up-to-date information when requesting services or making a booking.
- Ensure that the property is accessible on the scheduled service date and that any gates, codes, pets, hazards, or site restrictions are disclosed in advance.
- Maintain a safe working environment, including warning us of underground utilities, irrigation lines, hidden hazards, unstable ground, toxic plants, wildlife risks, and any known property issues.
- Obtain all necessary permissions, consents, and approvals from property owners, landlords, strata corporations, municipalities, or other third parties, as applicable.
- Ensure that any desired plants, products, or materials you supply are suitable for the site and legally permitted.
- Remove or secure valuables, fragile items, personal property, and obstacles before work begins.
- Promptly review completed work and notify us of any issues within a reasonable time after completion.
You are solely responsible for the condition of the property before and after the service, except to the extent of our proven negligence or wilful misconduct. Natural variation in plant health, soil conditions, weather impacts, and seasonal outcomes may affect results.
You must not request or require us to use any unlawful, unsafe, or restricted product or method. You agree that any information you provide regarding property conditions is true and complete to the best of your knowledge.
4. Payment Terms and Conditions
Unless otherwise agreed in writing, payment is due in full upon completion of services and receipt of invoice. For larger projects, custom design work, recurring services, or special-order materials, Maple Grove Garden Services Ltd. may require a deposit, progress payments, or prepayment.
By accepting our services, you agree that:
- All prices are in Canadian dollars unless stated otherwise.
- Applicable taxes, including GST/HST/PST where required, may be added to the quoted amount.
- Quotes are valid only for the period stated in the quote, or if no period is stated, for a reasonable time.
- Additional work requested by you or required due to undisclosed site conditions may result in extra charges.
- Material costs, disposal fees, travel surcharges, or specialty supply costs may be billed separately if disclosed in advance or reasonably necessary to complete the work.
- Late payments may be subject to interest at the maximum rate permitted by applicable law, together with reasonable collection costs.
If an invoice remains unpaid, we may suspend further services, retain title to any supplied materials to the extent permitted by law, and pursue all lawful remedies available to us.
5. Cancellation and Refund Policy
You may cancel or reschedule a service appointment by providing reasonable notice. For standard recurring or one-time services, notice of at least 48 hours is preferred unless the quote or work order states otherwise.
If you cancel with insufficient notice, fail to provide site access, or request cancellation after materials have been purchased, Maple Grove Garden Services Ltd. may charge a cancellation fee, restocking fee, or cost recovery charge to the extent permitted by law and disclosed in the quote or work order.
Deposits for custom work, garden designs, planting plans, special-order materials, or reserved service dates are generally non-refundable unless otherwise required by applicable law or expressly stated in writing.
Refunds, if any, are issued at our discretion in accordance with these Terms and any applicable consumer protection laws in British Columbia and Canada. Services already performed, materials purchased, and time spent on site or in planning are not refundable, except where required by law.
If weather, unsafe conditions, or other circumstances beyond our control prevent service completion, we may reschedule the service or, if rescheduling is not possible, provide a refund only for the portion not performed, less any non-recoverable costs already incurred.
6. Liability Limitations
To the fullest extent permitted by applicable law, Maple Grove Garden Services Ltd. shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of enjoyment, loss of profits, loss of business, or loss of plant stock, arising out of or related to our services, even if advised of the possibility of such damages.
Without limiting the foregoing, we are not responsible for damage or loss caused by:
- Pre-existing site conditions, including soil problems, drainage issues, disease, pests, poor irrigation, compaction, or contamination.
- Weather events, drought, frost, wind, hail, flooding, wildfire smoke, or other environmental factors.
- Undisclosed underground utilities, irrigation lines, or hidden objects.
- Failure of plants supplied by third parties or planted in unsuitable conditions.
- Acts or omissions of third parties, including contractors, tenants, neighbours, or property managers.
- Your failure to follow aftercare instructions or maintain plants after service completion.
To the fullest extent permitted by law, Maple Grove Garden Services Ltd.’s total liability for any claim arising out of or relating to the services will be limited to the amount actually paid by you to Maple Grove Garden Services Ltd. for the specific service giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for fraud, wilful misconduct, or any non-excludable consumer rights.
7. Intellectual Property Rights
Unless otherwise agreed in writing, all garden design concepts, planting plans, drawings, sketches, written recommendations, proposals, photos, templates, and other materials created by Maple Grove Garden Services Ltd. in connection with our services remain our property or the property of our licensors, as applicable.
Upon full payment, you receive a non-exclusive, non-transferable licence to use the deliverables we provide solely for the intended purpose of maintaining, planting, or implementing the project on the relevant property.
You may not copy, reproduce, distribute, sell, modify, publish, or use our designs or materials for other projects or properties without our prior written consent, except to the extent permitted by law.
You grant Maple Grove Garden Services Ltd. a non-exclusive right to photograph, document, and use images of completed work for internal records, training, quality control, and marketing purposes, provided that we do so in accordance with applicable privacy laws and without disclosing confidential personal information unless you have consented or disclosure is otherwise permitted by law.
8. Data Protection and Privacy
Maple Grove Garden Services Ltd. collects, uses, stores, and discloses personal information only as reasonably necessary to provide services, process payments, communicate with you, manage bookings, maintain records, improve service quality, and comply with legal obligations.
We handle personal information in accordance with applicable Canadian privacy laws, including applicable provincial private-sector privacy legislation and any relevant federal requirements.
By engaging our services, you consent to our collection and use of personal information for the following purposes:
- Preparing quotes, invoices, and service agreements
- Communicating about scheduling, access, service updates, and follow-up
- Processing payments and maintaining accounting records
- Responding to inquiries, complaints, and warranty or service-related questions
- Meeting legal, tax, insurance, and regulatory obligations
We take reasonable administrative, technical, and physical safeguards to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Force Majeure
Maple Grove Garden Services Ltd. shall not be liable for delay or failure to perform any obligation under these Terms where such delay or failure is caused by circumstances beyond our reasonable control, including but not limited to severe weather, fire, flood, ice, disease outbreak, labour disputes, supply shortages, transportation interruptions, government orders, power outages, emergencies, acts of war, civil unrest, or other events of force majeure.
In such circumstances, we may suspend, delay, modify, or reschedule services as reasonably necessary. We will make reasonable efforts to notify you and to resume services when conditions permit.
10. Changes to Terms
Maple Grove Garden Services Ltd. may update or modify these Terms from time to time to reflect changes in our services, operations, or legal requirements.
The updated Terms will become effective when posted, provided to you, or otherwise communicated to you, unless a later effective date is stated. Your continued use of our services after any update constitutes your acceptance of the revised Terms.
If a change materially affects a service already booked or in progress, the version of the Terms in effect when the booking was confirmed will generally apply to that service unless the parties agree otherwise in writing or the change is required by law.
11. Applicable Law and Jurisdiction
These Terms and any dispute, claim, or controversy arising out of or relating to them, our services, or any related invoice, quote, or work order shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
You agree that the courts located in British Columbia, Canada shall have exclusive jurisdiction over any dispute arising from or relating to these Terms, subject to any mandatory consumer protection or small claims procedures that cannot be waived under applicable law.

13. Severability Clause
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if that is not possible, severed from these Terms.
The remaining provisions will continue in full force and effect. The invalidity or unenforceability of any one provision shall not affect the validity or enforceability of the rest of these Terms.
